Uncontested divorce has many advantages
Although uncontested divorce is not always a viable option - it does have many advantages over traditional divorce litigation.
- Securing a divorce decree through mutual agreement is much less expensive and time-consuming than reaching the terms of divorce through litigation or even mediation.
- Divorcing couples understand their circumstances better than a court ever could - which means that they are in the best position to make essential decisions regarding property division, child custody, child support and alimony.
- In many cases, spouses will have an ongoing relationship even after the divorce decree is issued, particularly when children are involved. Uncontested divorce provides a stronger foundation for future interactions than divorce litigation.
Please note, these advantages do not necessarily mean that you can afford to proceed without an attorney. Even when you and your spouse can agree on the basic terms of the divorce, it is important to work with an attorney before the divorce decree is finalized. A skilled divorce attorney can make sure all of your concerns are fully addressed and that all necessary documentation is completed and filed.
While we are prepared to take your case to final hearing and/or trial, we try to encourage our clients to attempt to resolve a divorce or other family dispute with the other party in an uncontested manner. In order to prepare the documents for an uncontested proceeding, our fees begin at $750.00 and increase depending on the complexity of your case. This price is a flat rate price and includes the preparation of the marital settlement agreement and all of the necessary documents and attendance at the final hearing. Please note that our fee does not include any costs, which may include court related charges or other charges.
