What can't you include in a prenuptial agreement?

As your wedding day closes in you may begin to realize that you should discuss the creation of a prenuptial agreement with your soon-to-be spouse.

This can be a difficult conversation, so it's important to tread lightly and take the right approach.

Furthermore, you need to understand what you can and cannot include in a prenuptial agreement. Here are some of the many things you can't include:

  • Provisions associated with any illegal activity
  • Details regarding child custody or child support (such as one person saying he or she won't pay child support in the event of a divorce)
  • Waiving your right to receive alimony payments in the future
  • Language that encourages a future divorce so one person can financially benefit
  • Rules associated with personal matters, as opposed to those that are finance related

It's one thing to know what you can include in a prenuptial agreement, but another thing entirely to realize that there are details that have no place in this legal document.

Once you make a list of what you want to include, you can then learn more about doing so. If you find that something doesn't belong, you can always remove it before both individuals sign on the dotted line.

There are many benefits of creating a prenuptial agreement. As long as you take the right approach, by including the appropriate information, everything will fall into place. This is why you need to learn more about the finer details of creating a prenuptial agreement. Legal knowledge of this document will help you create the right type of agreement, thus putting your mind at ease.
