When the time comes to consider a prenuptial agreement, you must make sure you are on the same page as your soon-to-be spouse.

Although you may have different ideas of how to move forward at this point, you should at least discuss your basic thoughts in regards to a prenuptial agreement. This will put you on the right path to making decisions as to what you should do next.

It’s important to become familiar with the most common prenuptial agreement mistakes, as you don’t want any of these getting in your way:

  • Failure to make the prenuptial agreement legal. You can’t simply write up a contract and assume that it will hold up in the court of law. You need to meet all the contract formalities in your state.
  • An agreement made under duress. It’s important that both individuals have the opportunity and time to review the prenuptial agreement and decide what to do next.
  • Language regarding child support and child custody. Remember this: These decisions are made by the court in the best interest of the child. You can’t use a prenuptial agreement to determine child custody or support in the event of a divorce.

These are just a few of the most common prenuptial agreement mistakes. If you find yourself traveling down the wrong path, take a step back and revisit what you are trying to accomplish with this legal document.

As long as you are on the same page as your partner and create a legal prenuptial agreement, you won’t have anything to worry about as far as this is concerned.
