Prenups prevent surprises and simplify divorce

On Behalf of | Jan 21, 2016 | Prenuptial Agreements

When people complain to you about divorce, what are some of the things that they talk about the most? Are they unhappy with how complex the divorce is and how long it can take? Are they mad about things that they did not anticipate and have little control over?

Odds are, if you have friends who are splitting up or have in the past, you’ve heard these things before. What you need to know is that there is a way to keep this same thing from happening to you. Just use a prenuptial agreement.

A prenup makes a divorce case far more simple. You don’t have to fight over who gets the house or who brought a certain amount of money to the marriage. It’s all laid out in the prenup. You refer to it, split things up in line with the agreement, and continue on through the case.

It also eliminates surprises because less is put in the hands of a judge. Maybe you’re sure that the judge will give the home to you, but what if he or she rules that your spouse should get it because your spouse is raising the kids? You may be shocked, and you may not agree, but that doesn’t change the ruling. With a prenup, you know well in advance how things are going to play out, so you can plan properly and be ready.

There are still going to be things that must be decided, like child custody rights, but a prenup can reduce the workload. If you want to use one, learn how to file it properly in Florida so that it holds up.
